In England do you have to repay council tax if it was the authorities who made the mistake?

My sister in law sent in her details and was told she only had to pay £11 for the year as she is a single parent, earning a low wage. She has now had a letter saying "they made a mistake" and are now billing her for the full amount. She is pulling her hair out but I seem to remember that if its their mistake then she may not have to pay. Am I right.

If it's the current year, she has to pay. It's only previous years where they're not allowed to ambush you for past mistakes. Your sister should ask Citizens Advice to calculate her entitlement to Council Tax benefit to make sure that this time isn't the mistake.

She WILL have to pay the full amount as assessed by the Council. She may be able to have the monthly repayment reduced, but will have to pay the total. £11 a year is not a realistic Council Tax Bill by any stretch of the imagination, so she should have realised that there had been an error and queried it sooner.

The only way you will find a definitive answer, is to look through the Council Tax terms and conditions. It will be in the small print. I don't think they would send a demand for the money unless they knew they were on safe ground. Another option is for her to go to the Citizens Advice Bureau locally, who will establish this information for her.
