No, but you can file a form SS-8 and sic the IRS on them. If you are found to be an employee, you'll only have to pay the employee taxes.

If your company is forcing you to work as a contractor to avoid paying unemployment fees, etc., then you should go to your state's labor board/commission and file a complaint first.

If the labor board finds your company acted illegally in paying you as a contractor, then you could take some action to recover money that you lost, like the matching social security that a company has to pay for their employees.

A lawsuit isn't too likely to get your very far unless you were injured on the job and you weren't covered by employer paid worker's compensation insurance because the company was improperly paying you.

If you're actually a W-2 employee and they're trying to claim you should be a 1099 contractor, then you can report them to the IRS. In the long run, that will have a much greater effect on them than a lawsuit.

y not try to be not like every other american out ther, and actually be nice about it and live with it rather than suing bc u have no life and no money for ur self so u decide to make someone elses life crap bc u needa make urself feel better.....
